Hi all just pondering a thought.
A friend of mine was hit by a car in January of this year. His leg was broken quite severely and required a few operations, pins and a metal cage to repair it (forgive my lack of medical knowledge) His total recovery time was approx 3 – 6 months. He is now fully mobile but is restricted from certain activities due to the weakness in his leg.
What I want to know is how much personal injury compensation he is likely to get??? He is banding around figures of £250,000 but I am skeptical for a number of reasons.
1) The Judicial Board Studies Guidelines quotes £22,650 for a serious broken leg.
2) He has never been employed since leaving school 6 years ago so cannot claim loss of earnings.
3) He is a well known bull shitter.
4) He was messing around on a car park with a load of idiot boy racers at the time of the accident.
5) A friend who had a similar serious break AT WORK on his arm received only around £30,000.
So I guess I want everyones opinion, do you think he could get £250,000??? He has never been employed, is fully healed except for some possible future weakness in the leg. His Barrister is trying to claim it was his intention to join the Armed Forces and claim loss of potential earnings that way……even though this is complete crap because has done nothing with his life except sit on his backside at home smoking and claiming benefits in the 6 years since leaving school. He never enlisted in the forces or attended a single interview. His interest stopped at getting some brochures from the Army Careers office a few years back.
As we all joke his greatest achievment in life has been to get run over……..What do you all think??

When someone claims for a slip/fall accident on there premises,why do they fight it to the end when they know they are at fault?
does anyone know anything about this?
I fell 4yrs ago and my case is on going,my solicitor had to go to the court master and get permission to get an engineer to inspect the premises,the co council did not want this.

I had an accident about 2 years ago and have been persuing a personal injury claim as a result. I am due to go to court in the next few months and need to tie up any loose ends…
My question – Can I claim for future loss of earnings even though I am still employed – As a result of my accident I had to leave my previous job (IT Trainer) and take on a lower paid job instead (Technician).
With a 2 year gap out of the IT industry I will find it very difficult to get back to an IT Trainer role and my salary will never match that of an IT Trainer.
So although I am not disabled as a result of my accident, can I still claim for the gap in my salary?
I have been using the Odgen table 1 to calculate the loss of earnings from date of trail until retirement age of 65, but do I need to apply any additional mulitpliers to this scenario?

neurosurgeons request for a case conference. Over 2 months ago my specialist sent his first request to my opponents neurosurgeon to discuss injuries but their specialist is just ignoring mine. How long can this go on? The guideline says up to 6 weeks. My solicitor has a case conference with the court next Tuesday (1st December) I know that one of the reason they refuse is because the defendant’s insurance company may be trying to sort out quantum for an offer but is there any other reason they could refuse? Both neurosurgeons have opposing opinions.
They have also not put forward for inclusion the results of their parapsychologists tests, can I gain access to their report? Why aren’t they using it?
The quantum calculation by my solicitor is between £250, 000.00 and £317.000.00 I know it will not be anything like that amount, most is future loss of earnings as I worked full time as a CBT but now work around 12 hours a week. I was also 3/4 of the way through my masters and aimed to be a lecturer in CBT hence the high figure for future loss of earnings. Is the high amount alone causing the delays?
Is the refusal because a serious offer is imminent?

Hello
I injured my knee in my local gym 4yrs ago.I slipped on a wet floor,a worker in the gym was mopping the floors.I slipped on the floor which had been just moped,he did not have a sign up saying the floor was wet.The girl who was mopping the floor helped me up and said sorry.
I went to the hospital and a cast was put on my leg.I had tore ligaments and chipped my kneecap.
It is still giving me alot of bother and i have to get an operation on it.
I seen a solicitor just after it happened and he issued proceeding,the case is on going.
My solicitor had to get a court order to get an engineer to get a report on the floor.
The other side had me see there doctor 1year ago.
my siltier says they are just dragging there heels.We want a court date in october,but will this happen if iam still receiving treatment?
I had to change my job and take a lower paid one.
Are they taking so long becouse iam seeking future loss of earnings?
My knee is giving me alot of problems and doctors say iam getting arthritis in it.My solicitor says they are seeking 350 grand,but he will not say what i might get if we win the case.
I am 27.

I was involved in a car accident, and my insurance company has said it was my fault, and asked whether i accept liability, i said "no i don’t" next i get a letter from the womans (i hit up the back) solicitor saying that she has medical issues because of this accident and now they seek a personal injury claim. The police was not called to the scene of the accident when it happened. i don’t mind paying for the damage to her car, but trying to scam money out of me when she admits she is "okay" in my books, is wrong!
The name on the letter from her solicitor is not correct, and the poscode is not correct.
Any advice on this would be appreciative.

i like to add something here, in the solitors letter i got is a list of what she is claiming for, these include: backpains, nausea, shock, nightmares, neck aches, loss of earnings and of course the damage to her car, she is claiming for every possible injury u can get from a shunt like this. I just thought i would share these things with you

There is a report,used by the injured party’s solicitor when the full extent of the injuries are proved, it calculates total loss from loss of earnings,pain and suffering,past and future etc.

My mate has a claim in for an injury which occurred a few years ago,he has a good solicitor/barrister on the case from day one.
They have lodged a claim for £300.000.00.+.
This is mainly made up of future suffering and loss of earnings.
Will the insurance company let a case go to court or settle out of court?
