How to Get the Most For Your Injury Claim

Insurance companies know all too well that injured people who retain attorneys get far more for money for their claim.

I was in a car accident over 2 years ago, not my fault and the other driver was uninsured. The MIB were dealing with my whiplash personal injury claim but have now handed it over to the other drivers previous insurance company (due to legalities with insurance certificates etc.). Anyway, my solicitor has given Tesco insurance co. 21 days to respond to my offer to settle of £12,000. But he warned me that they are part of the RBS group, who usually take ages to settle and will more than likely dispute the amount and want to take it to court. My solicitor is going to issue court proceedings anyway if we do not get a response from Tesco within the next 21 days.

My question is – has anyone taken a personal injury claim through court and can you tell me how long it all takes to get settled?

Or has anyone been in a similar situation and can share their experiences?

I’m really hoping that because this case has been complex and run on for a long time, and is not a strightforward insurance claim, that Tesco will just agree and settle it for a maximum amount – but I’m probably being too optimistic!!

I’ve just received notice that someone whom I was involved in an accident with back in 2004 has made a personal injury claim against me. The accident was deemed my fault and the insurance company duly paid up. How can this guy suddenly decide 6 years down the line he’s going to make a claim against me?
My actual questions are:
- Will i have to pay out of my own pocket should the claimant win his claim
- Isn’t there a 3 year limit on personal injury claims?

Should i seek representation myself for this or just put them on to my (then) insurers?

any help would be gratefully received!

I had an accident 2 days ago, while sitting stationary a 4×4 hit into the back of me and made me hit the car in front. i only have a little saxo and the boot is dented and now doesn’t shut or lock and the insurance company (without seeing the car yet) have told me it will be written off and they will pay me what the car is worth. This part i understand, although until they have seen the car and paid me i wont believe the money is mine!

I am also slightly hurt but nothing major. I have had a head ache since it happened, i have a bruise on the back of my head (i had my hair in a pony tail and hit the headrest) and my neck shoulders and back are stiff and achey. The guy at the insurance company told me i didn’t need to go to a&e to claim for personal injury and yesterday he called to offer me £850 as an instant payment.
He also told me that i could pursue for more but it would take 6-12 months.

So now i don’t know what to do! How much do you get for whiplash if you take it further? I only ask as the money i will get for my car will not buy me anything great so anything that is available would be very useful in buying myself a replacement car! (hopefully one with an airbag this time!) Also they will not give me a courtesy car because of my age so i’m going to have to pay for buses or trains or something to get around for the next few days/weeks until i can find a car

any advise will be appreciated, i am not only trying to get money for the sake of it :)

Personal Injury Compensation?

I was awarded compensation for an RTA by a court in early May. How long does the insurance company have before they legally have to pay yor compensation to you following the courts ruling.

I authorise GPP to appoint a solicitor to act upon my behalf to pursue all claims for damages and uninsured losses arising in connection with the road traffic accident and I confirm that I have not already given such authority to any solicitor or claims recovery agent.

I agree not to accept any payment in settlement of any claim from any other source other than the appointed and also to undertake to disclose any offer made directly to me by any third party as soon as such is made.

I authorise the nominated solicitor to deduct and pay GPP the sum of £450 at the conclusion of the claim not depending on weather the claim is successful or not.

Should I at any stage wish to instruct a solicitor other than the solicitor appointed above then I authorise the appointed solicitor to notify GPP of this and I confirm that at that stage I will be liable to pay a fee of £450 to GPP for their services and I will not authorise or instruct the appointed solicitor to transfer my file of papers to any other solicitor until the above mentioned fee is paid in full.
PERSON WHO CRASHED INTO MY CAR ADMITTED FULL LIABILTY.

I further agree and fully understand the terms & conditions explained to me verbally and in writing by GPP.

i SIGNED IT LAST YEAR AND THE CLAIM HAS GONE THROUGH AND THE CHEQUE CAME BACK WITH £800 BUT THEY SAID A MISTAKE WAS MADE AND I SHOULD ONLY BE GETTING BACK £350 BECUASE THE REST IS THEIRS.
THE SOLICITOR IS THE MAN WHO OWNS THE COMPANY GPP WHO APPOINTED HIM SELF.

Personal Injury Claim?

I have just been awarded damages in a claim for personal injury by a court. How long will it take the insurance company to pay out.

although most personal injusry lawyers are no win no fee, i wanted to know how much do they charge the other party for their legal expenses, in this situation the claim has been taken to court as small track, less than 5000 case. i..e the personal injury claim itself is not worth more than 5000.
my solicitor friend informed me the money is not taken out of a settlement, but rather the legal expenses will then be sent to the other party afterwards. nonetheless i wanted to know on average for a good company, how much do they claim off the drivers insurance company who are liable.

ive always been in full time employment and never really thought twice about accident insurance, but now ive got a family depending on me i would like to know if anyone can point me in the right direction? i work as a full time fisherman and most likely accidents to occur are broken or lost fingers which i know most insurance companies dont pay out for. prime example of this is my father. when i was little he lost his left index finger and all he recieved from his insurance company was £19.48. i dont know about you but i know i couldnt survive for long on that!!!! im looking for a policy that will pay out a substantial amount for this kind of injury. i would be grateful for any advice anyone can give me.
